1. Información General1. General Information

ShyCuts es una plataforma tecnológica de intermediación operada por David Alejandro Mayen Garcia, inscrito como Pequeño Contribuyente ante la Superintendencia de Administración Tributaria (SAT) de Guatemala, comercializando bajo el nombre comercial "ShyCuts". ShyCuts is a technological intermediation platform operated by David Alejandro Mayen Garcia, registered as a Small Taxpayer before the Tax Administration Superintendence (SAT) of Guatemala, doing business under the commercial name "ShyCuts".

2. Aceptación de los Términos2. Acceptance of Terms

Al descargar, instalar o utilizar la aplicación móvil ShyCuts o el sitio web shycuts.com, usted acepta estos Términos y Condiciones en su totalidad. Si no está de acuerdo con alguna disposición, debe abstenerse de utilizar la Plataforma. By downloading, installing or using the ShyCuts mobile application or the shycuts.com website, you accept these Terms and Conditions in their entirety. If you do not agree with any provision, you must refrain from using the Platform.

ShyCuts se reserva el derecho de modificar estos Términos en cualquier momento. Las modificaciones serán notificadas a través de la App y/o por correo electrónico. El uso continuado de la Plataforma después de la notificación constituye aceptación de los términos modificados. ShyCuts reserves the right to modify these Terms at any time. Modifications will be notified through the App and/or by email. Continued use of the Platform after notification constitutes acceptance of the modified terms.

3. Descripción del Servicio3. Service Description

ShyCuts es una plataforma tecnológica que conecta a usuarios que buscan servicios de barbería a domicilio ("Clientes") con profesionales independientes de barbería ("Barberos"). ShyCuts is a technological platform that connects users seeking home barber services ("Clients") with independent barber professionals ("Barbers").

La relación contractual por la prestación del servicio de barbería se establece directamente entre el Cliente y el Barbero. Los servicios se prestan a domicilio, en la ubicación indicada por el Cliente al momento de agendar la cita. The contractual relationship for the provision of the barber service is established directly between the Client and the Barber. Services are provided at the location indicated by the Client when booking the appointment.

4. Registro y Cuenta4. Registration and Account

Para utilizar la Plataforma es necesario crear una cuenta proporcionando información veraz, completa y actualizada. Cada usuario es responsable de mantener la confidencialidad de sus credenciales de acceso y de todas las actividades que ocurran bajo su cuenta. To use the Platform, it is necessary to create an account providing truthful, complete and up-to-date information. Each user is responsible for maintaining the confidentiality of their access credentials and for all activities that occur under their account.

ShyCuts se reserva el derecho de suspender o eliminar cuentas que proporcionen información falsa o incompleta. ShyCuts reserves the right to suspend or delete accounts that provide false or incomplete information.

5. Edad Mínima5. Minimum Age

Para crear una cuenta en ShyCuts, el usuario debe ser mayor de 18 años. To create an account on ShyCuts, the user must be over 18 years old.

Los servicios de barbería pueden ser solicitados para menores de edad, siempre y cuando la solicitud sea realizada por su padre, madre o tutor legal responsable. El adulto responsable será quien agende la cita, autorice el servicio y asuma toda responsabilidad derivada del mismo. Barber services may be requested for minors, provided that the request is made by their parent or legal guardian. The responsible adult will be the one who books the appointment, authorizes the service and assumes all responsibility arising from it.

6. ShyCuts como Intermediario6. ShyCuts as Intermediary

La función de ShyCuts se limita a: ShyCuts' function is limited to:

• Facilitar la conexión entre Clientes y Barberos.Facilitating the connection between Clients and Barbers.
• Proporcionar herramientas de agendamiento de citas.Providing appointment scheduling tools.
• Procesar pagos a través de un procesador de pagos externo (Tilopay).Processing payments through an external payment processor (Tilopay).
• Facilitar la comunicación entre Clientes y Barberos mediante un chat integrado.Facilitating communication between Clients and Barbers via an integrated chat.

ShyCuts no emplea ni supervisa a los Barberos, no controla la calidad de los servicios y no proporciona herramientas o insumos para la prestación del servicio. ShyCuts does not employ or supervise the Barbers, does not control the quality of the services and does not provide tools or supplies for the provision of the service.

7. Obligaciones del Cliente7. Client Obligations

• Proporcionar información veraz al registrarse y al agendar citas, incluyendo dirección exacta para el servicio a domicilio.Provide truthful information when registering and booking appointments, including the exact address for the home service.
• Estar presente en la dirección indicada al momento de la cita.Be present at the indicated address at the time of the appointment.
• Proporcionar un espacio adecuado para la prestación del servicio.Provide an adequate space for the provision of the service.
• Tratar al Barbero con respeto y dignidad.Treat the Barber with respect and dignity.
• Realizar el pago exclusivamente a través de la Plataforma.Make the payment exclusively through the Platform.
• Comunicarse con el Barbero exclusivamente a través del chat de la Plataforma. Está prohibido compartir o solicitar información de contacto personal.Communicate with the Barber exclusively through the Platform's chat. Sharing or requesting personal contact information is prohibited.

8. Obligaciones del Barbero8. Barber Obligations

El Barbero se registra como profesional independiente. No existe relación laboral entre el Barbero y ShyCuts. El Barbero es responsable de: The Barber registers as an independent professional. No employment relationship exists between the Barber and ShyCuts. The Barber is responsible for:

• Poseer las habilidades, conocimientos y herramientas necesarias.Possessing the necessary skills, knowledge and tools.
• Cumplir con todas las disposiciones legales, fiscales, sanitarias y regulatorias aplicables.Complying with all applicable legal, tax, sanitary and regulatory provisions.
• Mantener sus herramientas en condiciones óptimas de higiene y seguridad.Keeping their tools in optimal conditions of hygiene and safety.
• Presentarse puntualmente en la dirección del Cliente.Arriving punctually at the Client's address.
• Prestar el servicio con profesionalismo y diligencia.Providing the service with professionalism and diligence.

Obligaciones Fiscales del BarberoBarber Tax Obligations

Cada Barbero debe estar inscrito ante la SAT (como Pequeño Contribuyente u otro régimen fiscal aplicable) y emitir las facturas correspondientes por los servicios que presta. ShyCuts no emite facturas en nombre del Barbero. Each Barber must be registered with the SAT (as a Small Taxpayer or other applicable tax regime) and issue the corresponding invoices for the services they provide. ShyCuts does not issue invoices on behalf of the Barber.

Prohibición de Compartir DatosProhibition on Sharing Data

ShyCuts podrá auditar las conversaciones del chat para garantizar el cumplimiento de estas normas. ShyCuts may audit chat conversations to ensure compliance with these rules.

9. Política de Cancelaciones9. Cancellation Policy

Cancelaciones por parte del ClienteCancellations by the Client

El Cliente puede cancelar una cita agendada. Los fondos previamente autorizados serán liberados. The Client may cancel a scheduled appointment. Previously authorized funds will be released.

Cancelaciones por parte del BarberoCancellations by the Barber

Si un Barbero acumula 3 o más cancelaciones en un período de 60 días, su cuenta será bloqueada. ShyCuts se reserva el derecho de evaluar las circunstancias y aplicar excepciones justificadas. If a Barber accumulates 3 or more cancellations within a 60-day period, their account will be blocked. ShyCuts reserves the right to evaluate the circumstances and apply justified exceptions.

Inasistencia (No Show)No Show

Si el Barbero no se presenta a una cita confirmada sin previo aviso, se contará como cancelación para efectos del bloqueo. If the Barber does not show up to a confirmed appointment without prior notice, it will be counted as a cancellation for blocking purposes.

10. Pagos, Comisiones y Facturación10. Payments, Commissions and Invoicing

Todos los pagos se procesan exclusivamente a través de la Plataforma utilizando Tilopay. All payments are processed exclusively through the Platform using Tilopay.

Flujo de PagoPayment Flow

1. Al agendar una cita se autoriza el monto en la tarjeta del Cliente (sin cobrar).When booking an appointment, the amount is authorized on the Client's card (without charging).
2. Si la cita se completa, se captura el monto autorizado.If the appointment is completed, the authorized amount is captured.
3. Si la cita se cancela, se libera la autorización sin cobro.If the appointment is cancelled, the authorization is released without charge.

Monto y ComisiónAmount and Commission

El monto total incluye el precio del servicio + IVA (12%). La distribución es: The total amount includes the service price + VAT (12%). The distribution is:

• 25% para ShyCuts (comisión por uso de la Plataforma).25% for ShyCuts (commission for use of the Platform).
• 75% para el Barbero (pago por su servicio).75% for the Barber (payment for their service).

ShyCuts emite factura únicamente por su comisión. El Barbero es responsable de emitir su propia factura. ShyCuts only issues an invoice for its commission. The Barber is responsible for issuing their own invoice.

11. Limitación de Responsabilidad11. Limitation of Liability

ShyCuts, como intermediario tecnológico, NO es responsable por: ShyCuts, as a technological intermediary, is NOT responsible for:

• Daños físicos, lesiones, reacciones alérgicas o cualquier perjuicio a la salud causado por el Barbero.Physical damages, injuries, allergic reactions or any health harm caused by the Barber.
• Daños materiales a la propiedad del Cliente durante el servicio a domicilio.Material damages to the Client's property during the home service.
• La calidad, resultado estético o satisfacción con el servicio.The quality, aesthetic result or satisfaction with the service.
• Pérdida o daño de objetos personales.Loss or damage to personal items.
• Conducta inapropiada, negligencia o actos ilícitos del Barbero.Inappropriate conduct, negligence or illegal acts by the Barber.
• Incumplimiento de obligaciones fiscales, sanitarias o legales del Barbero.Breach of tax, sanitary or legal obligations by the Barber.

Cualquier reclamación deberá dirigirse directamente al Barbero. En ningún caso la responsabilidad total de ShyCuts excederá el monto de las comisiones cobradas al usuario en los últimos 3 meses. Any claim must be directed directly to the Barber. In no case will ShyCuts' total liability exceed the amount of commissions charged to the user in the last 3 months.

12. Propiedad Intelectual12. Intellectual Property

Todos los derechos de propiedad intelectual sobre la Plataforma son propiedad exclusiva de ShyCuts. Las fotografías de portfolio son propiedad del Barbero que las cargó; al subirlas, otorga a ShyCuts una licencia no exclusiva para mostrarlas dentro de la Plataforma. All intellectual property rights over the Platform are the exclusive property of ShyCuts. Portfolio photographs are the property of the Barber who uploaded them; by uploading them, they grant ShyCuts a non-exclusive license to display them within the Platform.

13. Reseñas13. Reviews

Los Clientes pueden dejar reseñas después de completar un servicio. Solo se permite una reseña por cita completada. ShyCuts se reserva el derecho de eliminar reseñas que contengan lenguaje ofensivo, información personal de terceros, contenido falso o spam. Clients may leave reviews after completing a service. Only one review per completed appointment is allowed. ShyCuts reserves the right to remove reviews containing offensive language, third-party personal information, false content or spam.

14. Comunicaciones y Chat14. Communications and Chat

El historial de conversaciones se almacena de forma permanente, ya que cada mensaje constituye dato de ambos participantes de la conversación. ShyCuts podrá auditar este historial para verificar el cumplimiento de los Términos, investigar conducta inapropiada y resolver disputas. Conversation history is stored permanently, as each message constitutes data of both participants in the conversation. ShyCuts may audit this history to verify compliance with the Terms, investigate inappropriate conduct and resolve disputes.

Está prohibido utilizar el chat para compartir información de contacto personal, acordar servicios fuera de la Plataforma o enviar contenido ofensivo. It is prohibited to use the chat to share personal contact information, arrange services outside the Platform or send offensive content.

15. Suspensión y Terminación de Cuentas15. Account Suspension and Termination

ShyCuts se reserva el derecho de suspender o terminar cuentas por: ShyCuts reserves the right to suspend or terminate accounts for:

• Violación de estos Términos.Violation of these Terms.
• Compartir información de contacto personal (bloqueo permanente para Barberos).Sharing personal contact information (permanent block for Barbers).
• Acumulación de cancelaciones excesivas.Accumulation of excessive cancellations.
• Conducta inapropiada verificada.Verified inappropriate conduct.
• Uso fraudulento o intentos de evadir el sistema de pagos.Fraudulent use or attempts to evade the payment system.

La eliminación de cuenta solicitada por el usuario se bloqueará automáticamente si existen compromisos activos: Account deletion requested by the user will be automatically blocked if there are active commitments:

• Citas pendientes o aceptadas como cliente o barbero.Pending or accepted appointments as a client or barber.
• Pagos autorizados pendientes de captura (cliente).Authorized payments pending capture (client).
• Ganancias pendientes de transferencia (barbero).Earnings pending transfer (barber).

El usuario deberá resolver estos pendientes antes de proceder con la eliminación. The user must resolve these pending items before proceeding with the deletion.

El usuario puede solicitar la eliminación de su cuenta en cualquier momento desde la sección de Configuración de la App. Consulte la guía paso a paso. The user may request the deletion of their account at any time from the App's Settings section. See the step-by-step guide.

16. Indemnización16. Indemnification

El Barbero se compromete a indemnizar a ShyCuts frente a reclamaciones que surjan de la prestación de sus servicios, incumplimiento de estos Términos o violación de leyes aplicables. El Cliente se compromete a indemnizar a ShyCuts frente a reclamaciones por uso indebido de la Plataforma o provisión de información falsa. The Barber agrees to indemnify ShyCuts against claims arising from the provision of their services, breach of these Terms or violation of applicable laws. The Client agrees to indemnify ShyCuts against claims for misuse of the Platform or provision of false information.

17. Ley Aplicable17. Applicable Law

Estos Términos se rigen por las leyes de la República de Guatemala. Las partes se someten a la jurisdicción de los tribunales competentes del departamento de Guatemala. These Terms are governed by the laws of the Republic of Guatemala. The parties submit to the jurisdiction of the competent courts of the department of Guatemala.
